The Labour Court has backed a claim taken by Fórsa on behalf of a member in Carlow County Council.

 

The court ruled that a dual duties allowance – withdrawn by management – shouldn’t have been stopped because the worker continued to undertake the additional duties.

 

Fórsa official Shay Clinton said the council had not engaged with the worker or the union about its rationale for removing the allowance until the union referred the matter to the Workplace Relations Commission (WRC) for adjudication.

 

The allowance ceased to be paid from December 2016. But management offered no explanation until a December 2019 adjudication hearing.

 

“The Labour Court was not satisfied that sufficient information had been put forward by management for the removal of the allowance,” said Shay.
